Open carrying a BB Gun while voting at school

I vote in a school and had three rifles and 2 handguns... so I parked on the street. I'm too busy today to protest.
As long as your rifles are in cases or on a rack (unloaded) and your sidearms likewise unloaded and in a closed container, you could park ON SCHOOL PROPERTY as per 18.2-308.1(C)(v).

No violation.

A much better goal would be getting "with the intent to commit a crime" added to the current statute...
I could just see a whole load of "arrest him now and charge him later" malarkey leaving the burden on the citizen to prove he DID NOT have nefarious intentions.

I am no VA law expert, but after 22 years of law enforcement as a 9-1-1 specialist in Illinois, I learned a thing or three.......

In IL, while you are not carrying a handgun, if it appears similar to one and it causes another person distress, you can be charged with disorderly conduct. I would not be surprised if a similar law would be violated in VA.

I would not be surprised if you were violently taken down as a preemptive measure, cuffed and manhandled into the back of a cruiser all while being barked at by officers pointing real guns and tazers at you.

And your little stunt, while possibly (though not absolutely) legal, will probably not endear you to the local magistrate either.

My suggestion, as from others, is to encourage legislative restructuring to remove the prohibition altogether AND work for that brass-ring - state level preemption.

I carried an open holster to the polls today at an elementary school. Nothing really said, one or two looks. nothing more.

Is school is session during these times that the premises are being used as polling stations?

In Fairfax County the answer is no. The students have off and the teachers are conductig parent conferences. I believe it is the same throughout the state.

I don't know about today, because I voted at about 5:30, but I am certain that I have voted in the past while the school was in session. They isolate the section of the building and use a dedicated entrance to keep students away from the area. So unless it's a recent development to the contrary, it would seem that there is no state-wide answer.

I actually really doubt it. IL is decades behind VA when it comes to freedoms.

As we have seen with Skidmark, anyone can be charged with anything, for any, or for no reason whatsoever. The question is, what can be convicted. And so far from what we've seen in Virginia, this has not been a widespread problem in recent times.

I just don't see the logic in it.

One of the benefits of open carry is its deterrent effect upon dirtbags. A realistic looking holstered BB gun might provide some or all of that deterrent effect. When I write BB gun I include those little plastic pellets that I used to practice with in my hallway. The plastic BBs were shot by electric spring and would stick to the target.

About dirtbags: There are no guarantees. Open carry might deter. Open carry might provoke. I believe that the deter is alot more likely than the provoke.

About LEO: It will provoke. They might recognize that no law was broken. They might try to make something up.

I think the "crazy meth junke" is more interested in getting MORE METH and is going to hock any gun he/she has to this end.

And BB GUNS ARE NOT DEFENSIVE TOOLS BUT if this is the only thing that you can quickly bring onto target and rapidly place a couple "ROUNDS" on your target and can't stand LOUD NOISES then carry away. Won't be very effective but it is a little better than a paperweight!
