    City Hall Park- Burlington

    Was just watching the police update on the shooting in the park. He stated there was a city regulation of no guns allowed in the park. Is this not a violation of Vermont Code § 2295? Just wondering.

    No Vermont Takers?

    Ok, looks like it does, here is their (Burlington) regulation:

    "Sec. 22-12. - Firearms prohibited.

    No person shall carry or have any firearms in any of the city parks, and no firearms shall be discharged in, from or into the same.

    (Rev. Ords. 1962, § 3903)

    Cross reference— Shooting galleries to be licensed, § 4-6; firearms prohibited in cemeteries, § 9-13; discharging firearms prohibited, § 21-12; bow and arrow and air guns prohibited, § 21-10."

    State Code:

    "24 V.S.A. § 2295. Authority of municipal and county governments to regulate firearms, ammunition, hunting, fishing and trapping




    § 2295. Authority of municipal and county governments to regulate firearms, ammunition, hunting, fishing and trapping
    Except as otherwise provided by law, no town, city or incorporated village, by ordinance, resolution or other enactment, shall directly regulate hunting, fishing and trapping or the possession, ownership, transportation, transfer, sale, purchase, carrying, licensing or registration of traps, firearms, ammunition or components of firearms or ammunition. This section shall not limit the powers conferred upon a town, city or incorporated village under section 2291(8) of this title. The provisions of this section shall supersede any inconsistent provisions of a municipal charter. (Added 1987, No. 178 (Adj. Sess.), eff. May 9, 1988.)"

    Also State Code 24 § 2291. Enumeration of powers..... (8) To regulate or prohibit the use or discharge, but not possession of, firearms within the municipality or specified portions thereof, provided that an ordinance adopted under this subdivision shall be consistent with section 2295 of this title and shall not prohibit, reduce, or limit discharge at any existing sport shooting range, as that term is defined in 10 V.S.A. { 5227.

    Give me a break, Burlington PD does not care about preemption. We are talking about a police force that takes great pride in ticketing taxicabs for picking up drunks in front of bars and not being in a cabstand. Corporal Glynn heads of this group of misguided stormtroopers who's only priority is keeping skateboarders off the marketplace. The short, stubby, hairy-necked, french candian locals all named "Bushey" are too stupid to fight anything in court.

    Lt Emmett Helrich is the only good cop on the force with anything that even resembles common sense. He should have been chief, not Mayor Kiss's current talking mouthpiece.
