Yes indeed. It is in fact a .40 Hydra-Shok. The "tree" is from one of those Christmas village sets. IIRC, the package label even said "Bare Tree".

In my opinion they are useless because no one really know how they will react in a one of situation until it happens, especially a high stress "shoot/ no shoot situation.
