    Thumbs up Senator Wanggaard, Committee Chair on AB-237

    Again thank you for your patience in waiting for an answer to your concerns. You had asked what being a former police officer had to do with this issue. Well, Senator Wanggaard takes anything to do with law enforcement seriously, and it is personal because of his background. As passionate as you were against this bill, the Senator is just as passionate when comes to a law enforcement issue. Senator Wanggaard signed onto AB 237 because he believed there was a flaw in the way already written laws were unenforceable.

    AB 237 was debated in the Assembly and passed out of committee with both the Democrats and Republicans on that committee voting for it. It passed out of committee on a 9-0 vote. So, this bill had bipartisan support, and as you probably know, in this political environment that is becoming more and more difficult.

    By Senator Wanggaard signing onto this bill it allowed us to debate the issue with other Legislators and with the Senator's constituents. After listening to other Legislators, and the Senator's constituents, Senator Wanggaard has elected not to bring AB 237 forward in the Senate, essentially stopping it.

    For reference, this was the bill that allowed officers to arrest for civil forfeitures. AKA the bill brookfield said would have prevented them from getting sued by Krysta when she was arrested wrongfully for open carry at a church and subjected to unlawful search/seizure without RAS after they did a felony stop.

    Boar, can you forward this email to me. I would like a address a few of the points above with this gentleman. I want Sen. to with draw his name from the bill, because it he doesn't, it will be used against him in a recall election and I don't want the Dems to gain majority in the Senate.

    I know there are members with more ability than me in these matters; would you please step forward. I just ran through Senator Wanggaard's Committee page on bills in Senate, and found no mention of AB-237 for consideration.

    Would someone else please verify this, for my limited ability with these issues will not allow me to guaranty anything. boar out.

    AB237 in an Assembly bill, so until it passes the Assembly, you will not see it in a Senate committee.

    Sen. Waangard is NOT even on the Senate Committee that would hold a public hearing on it IF it even got that far.

    You can see that the bill was unanimously passed out of the assembly committee on Criminal Justice and Corrections, on Oct. 25, 2011.

    It was referred to the assembly committee on Rules that same day.

    There has been no further action on the bill in 2 months, except for the loss of two more coauthors.

    It's passage is not likely. Discussion of this bill, at this time, does not seem worthwhile.

    We can now rest until you sound the alarm to let us know when to be concerned. If, as you have claimed, there has been no movement after 10/25, why was I told on 12/7 I'd receive a definitive answer to my probing emails on 12/9, and did. It is the first post on this thread. Then, on Saturday, 12/10 Senator Wanggaard called me at home further explaining the cause and effect of his involvement. boar out.

    The email that is the first post in this thread, which you claim is from Sen. Wangaards office, states that there has been no action since the day (Oct. 25, 2011) that the bill was passed unanimously by the assembly committee on Criminal Justice and Corrections. The end of your first post seemed to declare ANOTHER VICTORY! Why are you still concerned?

    Future action, if any occurs, will be by the assembly committee on Rules, where the bill was referred to on that same day. Senator Van Wanggaard, is in the Senate, and has NO direct power over the next action on the bill. He is the Chair of the Senate Committee on Labor, Public Safety, and Urban Affairs.

    I don't claim anything. I don't intend to explain, the information put in your first post. If you are able to read the information in the link regarding the bills history, you might see it for yourself.

    ... a question, and for reasons only known to you, you answered. My continued concern rises out of the fact that I don't trust politicians.
    The, "once again" lead to your post carried with it sarcastic undertones which implied disgust; and was further reinforced with your closing. If I want to be talked down to, I'll get married, quit my job, and move in with the mother in-law. boar out.

    I know what the bill history is, but try to find the bill number where it's said to be, I couldn't, and that was the point. I look for the truth, and try to invoke curiosity in other members.

    I call them as I see them, and take them as they come. When one chooses to advocate for a contested cause, there not making friends. boar out.

    Click on "Items Currenty in Committee". Its the third item in the box on the right.

    Scroll down and you will see it. This is where it had it's last breath and died. Like it has been said, it will not come out of this committee.

    Now this is a definitive answer, and...

    ...that's I wanted to see. I know I'm a dogging bastard when I think I have to be, and this Bill was reason enough for me to take a few knocks on the chin. We would have lost too much if this was made law.

    With the Recall moving forward I felt the Senator needed to reinforce his claim with a definite NO on 237, and now, he has. Let those who desire to be represented with Constitutional conscience be sure to stand up for the Senator like he has for us. If a recall on the Senator does occur, get out and vote!!! boar out.

    I again spoke to Senator Wanggaard about your concerns with AB 237. The bill will be on the commitee calendar until the end of the session, which is in March. Just because you still see it listed does not mean it will be acted upon. This happens all the time. Senator Wanggaard informed me that the bill is not going anywhere.

    In the future when a piece of legislation peaks your interest you can go to Senator Wanggaard's state web site and click on alerts on the top of the page. By doing this you will receive an alert anytime that piece of legislation has any action on it.

    We hope that this elevates any concerns you may still have about AB 237. Should you still have concerns over this, or any other concerns, please contact me, or any of our staff.
