In the 2008 general election, the only presidential candidate who legally qualified to be on the Texas ballot was Bob Barr (LP).

Texas didn't care, they put Obama and McCain on the ballot as well. The Texas supreme court rejected a challenge to the ballot without a single word of explanation.

Perry and his cronies don't care what the law is, they just want to get their way.

It seems that the litigants are following the repub playbook, "If you can't win legally, change the rules".
