Hello all,

First, Thanks to this site and the inputs of others I have been able to answer a great deal of questions about lawful carry in the states I frequent.

Now to my question,
I have family in Louisiana and will be coming for a visit soon and need some help understanding a few things. I did a search and did not come up with sufficient results.

Mainly I will be in the Lake Charles/Moss Bluff area but will travel out to Sulfer and possibly Lafayette and down to Eunice depending on family. While I am there I plan to conduct my first OC and would like to clarify some language I see in the Lake Charles Ordinances.

13-28.1
Illegal carrying of weapon in business establishment where alcoholic beverages are sold is:

(1)The intentional possession of any firearm or other instrumentality, customarily used or intended for probable use as a dangerous weapon, on one's person, in an establishment where alcoholic beverages are sold;

(2)The possession, custody or use of a switchblade knife, spring knife, or other knife, or similar instrument having a blade which may be automatically unfolded or extended from a handle by the manipulation of a button, switch, latch or similar contrivance, or any knife with a blade in excess of four inches, in an establishment where alcoholic beverages are sold.


Does this then prohibit the ability to OC in establishments such as the gas station, wal-mart, or malls? Or as in the majority of Louisiana, simply prohibits where alcohol is consumed such as the casinos, restaurants, and bars?

According to the rest of the ordinance, the answer appears to be... yes.

Definitions.

(1)

The words "business establishment," within the meaning of this section, shall be deemed to be any structure located upon real estate, which is used for the sale of alcoholic beverages, as defined herein, to any person.

(2)

The words "alcoholic beverages," as used in this section, shall have the meaning given in R.S. 26:241(1).

You are likely referring to "preemption" - where the state law prevails over that of municipalities.

Problem is that those laws on the books before preemption were allowed to stay on the books and are thereby enforceable.

In effect Louisiana has limited preemption - the date of the local ordinance/law becomes most important.

Which means we, as in gun owners and carriers, need to be made aware of these legal landmines and work to remove them. MEM was suscessful in removing restrictions on carrying guns in Amite City. LOCAL members helped to have restrictions in St Helena Parish removed.
Looks like we need to work on this municipal code too.
