    If a felon can be properly disbarred his rights under color of law then we may all be legally disarmed merely by sufficiently lowering the bar of felony.

    Unfortunately he relied on faulty data, that could be a mitigating factor in the case, but he did break the law, though inadvertently.

    Always use a reliable source for information about the laws in a particular area.

    That is one of the main problems besides New York being New York. We have so many laws on the books about you can carry here but not here or only during this time of year but not this time. The 2nd needs to be reaffirmed and places like NY and DC get told where to shove it when trying to restrict law abiding citizens.

    Unfortunately for all of these people, even if New Yorkers are educated enough to know what it is, it's NYC so any jury there probably won't give them jurry nullification.

    LOL...I think he means it lacks mens rea. We really do need to go back to our Blackstone roots.

    Quite the opposite.

    Under common law, mens rea is required for a conviction.

    It has been tossed to the side as irrelevant.

    Hell, even the bible references it..in terms of accidentally killing someone...

    At least one good thing is NY is starting to get a little worried about the perception of their laws when you have a few people recently go through this and is starting to show what draconian laws they have.

    I wonder if it would work for other States to refuse to recognize convictions under NY's evil anti-self-defense laws.

    New York refuses to recognize out-of-state permits, no?

    So, Virginia just refuses to acknowledge the conviction, and invites the former Marine to move here.
