2012 Firearm bills for the legislature

So since all bills were due yesterday here is this years list of all bills that will be referred to either the House or Senate public safety committees that deal with OC or CC. Click the Bill number to read the text of the bill.

HB 2193 - Allows ammo to be stored in locked cars in parking lots

HB2309 – no longer required to notify LEO unless specifically asked

HB2332 – Private property open carry

HB2383 – Remove fixed pricing for CC class

HB2384 – Remove elementary schools from precluded places, but must have written permission to CC on property

HB2416 – illegal to display CC intentionally in an angry or threatening manner, brief exposure not in violation

HB2417 – adds public or private to elementary and secondary school prohibited place. Allows school districts to set policies to allow CC on school property.

HB2514 – adds public to elementary and secondary school prohibited place. Allows private schools to make policy to allow CC on school property

HB2522 – Convert CWL to a handgun license and allow for either open or concealed carry. No change in price. Open carry pistol would have to be in a belt holster.

HB2537 – Provides for accidental exposure, treat elementary schools as universities (allowed in parking lots, other places with written permission), reduces fail to notify to a 100 fine, business open to the public that wish to prohibit carry must post signs, and carrying on that property is not a criminal act.

HB2550 – Looks identical to 2522

HB2701 – Allow legislatures and Sgt at Arms with CWL’s to carry on Capitol Grounds

HB2703 – Modifying preclusions from a CWL

HB2776 – If you are not a prohibited person, the federal gun free school zone act does not apply to you, you have been licensed by the state.

SB1076 – Modifying preclusions

SB1092 – Allow OC

SB1541 – Allow AG and AAG’s to carry after a safety course

SB1547 – allow legislators to carry after a safety course

SB1548 – remove fee for CWL course

SB1549 – Security bypass for CWL holders

SB1550 – Remove fingerprint requirements from CWL application

SB1705 – Makes CWL instructors licenses good for 10 years instead of 5

SB1733 – OC with a CWL, judges carry in courtrooms and offices

SB1785– Reciprocity with non-permitting states

SB1810 – open Car Carry for non-cwl holders.

SB1834 – Allows carry in motor homes as homes when being lived in

SB1945 – removing certain mandatory preclusion

When I have a bit more time, I'll try and create a list for adding these items into the bill tracking system.

Your list is clearly more comprehensive than mine. I'd love to be a fly on the wall in the Public Safety Committee this session.

I wish they would just pass an amendment to 1272 (Unlawful Carry) that states carrying any of the listed items for self defense is legal. It would instantly clear everything up. But then again doing that would effectively turn us into a Constitutional Carry state and would make the CCW permit pointless unless you want it for travelling so naturally I don't see this happening.

I hope this year we can finally get open carry passed.

Copy this list, then go to the state Bill Tracking System. On the Left, under Bill Tracking Reports, click on Personal Bill Tracking. In the center-ish part of the screen, you should see a box labeled New Measure Number. Paste the above list into this box and click Add To List. Once the items are in your list, click Save List so you don't have to paste it in all the time. Now every time you go back to the Personal Bill Tracking, all you need to do is click Retrieve to get the current status of all those bills.

Once you click on an item to receive more information, you can add it to your LENS tracking system (requires you to set up an account) and you can receive email updates about the status of bills. The catch is, you can only set up 25 bill in the LENS system for automated tracking.

Sb1354

SB1364 - would allow a person who is exempt from taking the required safety class to get a CWL, to also be exempt from the required instructor training course to be a CWL instructor.

This bill came out of the Senate Public Safety Committee with a Do Pass recommendation.

There are currently no firearms bills scheduled for the House Public Safety Committee meeting on 2/15

Sb1834

SB1834 came out of committee with a do pass recommendation pending the committee report. This bill would treat a motor home as a house instead of a vehicle when they are set up as a permanent or semi-permanent living area.

Ive looked on the oklahoma legislature website but i cant find any updates on SB1092, HB2522 or HB2550. Have you heard anything since they reconvened today

I never got a reply back from your 2A reps, but oh well, anyway, how about this.

Bill to make .270 wording comply with recent US Supreme cout rulings.

Reason. .270 was written with "bear arms" as a corporate right, not an individual right. Recently teh US Supreme Court has ruled that the right to bear arms in an individual right. Therefore, to bring OK statute .270 in line with those rulings, be it enacted that:

The word "concealed" be added before the word "carry" in sentence one of .270.

Do you want to wing that passed your legislature? It would completely solve you OC problem and you would be right in line with ID which has very similar state constitutional working. This change is as simple as it gets.

At this point, it would have to be added as an amendment to another bill. The deadline for new legislation has passed. Either that someone's shell bill would have to be able to make it to the floor.

Not so much. In Oklahoma, only amendments that pertain to the bill can be added. None of this add a gun amendment to a financial bill type of thing. So we would have to wait for a bill to make it to the floor. As of yet, none of the gun bills where we could do this have made it out of committee, and with only 7 days left before they are dead

The Public Safety Committee of the Senate will hear bills on 2/23 and of the House will hear bills on 2/29

Hb 2416

HB2416 was passed out of committee with a Do Pass recommendation. This bill addresses accidental exposure when CC and also prevents the government/LEA from confiscating firearms and/or ammunition during a state of emergency. Vote was 15 - 0.

Hb2522

Also passed out of the House Public Safety committee today was HB2522 which would allow a licensed concealed carrier to also carry openly.

This bill converts the CC permit to a carry permit. It also adds to state preemption so municipalities can not issue public disturbance type fines for OC. LEO can ask to see your permit just because, OC on personal property w/o license for self-defense and self-protection or any other legitimate purpose.

The only thing that was lost was we still must notify LEO on first contact of arrest, detainment or traffic stop. However the fine for failure was reduced to $100.00

Passed on a 13 - 2 vote. The 2 no's were Roan and Hardin. It is expected Hardin voted no because there was nothing to require licensed OCers to display their permit openly so LEO would know they were licensed. He asked for a 3 year sunset on this so after 3 years there would be no need to display the permit. Rep Martin did not accept this as a friendly amendment due to privacy issues.

Short List

Here is a list of firearm related bills that made it out of committee and to the General Order for their respective legislative body:

HB2416 - Allows for accidental exposure of CC, also prevents state agencies or police from confiscating firearms and ammunition during any declared state of emergency

HB2522 - converts CC license to a carry license, add ammunition to the parking lot exemption, reduces failure to notify fine to $100, adds state preemption for OC not being a public disturbance, allows LEO to approach an OCer and ask for permit.

HP2988 - adds places of worship to the castle doctrine

SB1364 - allows persons exempt from getting a CC permit to be instructors without having to get a permit. Currently on those with a permit can be instructors.

SB1541 - authorizes the Attorney General or any Assistant Attorney General of the state to carry a firearm anywhere in the state after successful completion of an approved firearm training course that meets the requirements set fourth by CLEET

SB1548 - removes the $60 max fee instructors can charge for a CC class

SB1733 - converts CC license to a carry license, allows any judge to carry in courthouse building with a CC permit

SB1760 - Riot Control Prevention Act - would prevent any state agency or police from being able to confiscate firearms or ammunition during any declared state of emergency.

SB1785 - if a state allows CC, but does not have a permit, OK would treat that person as if their state did have a permit.

SB1834 - defines when a motor home is considered a home vs a vehicle
