    VCDL Action Items- UPDATED 01/24/12 Let's Roll!!!!!!

    First VCDL action items of the year!!!!!

    ACTION ITEM

    We need to act on the following bills:

    SB 245, Senator Obenshain's bill that provides that nothing in the Emergency Services and Disaster Law shall be interpreted to limit or prohibit the possession, carrying, transportation, sale, or transfer of firearms, is going to be heard in the Senate General Laws and Technology Committee on Monday, January 23, 45 minutes after the Senate adjourns.

    HB 139, Delegate Cole's Constitutional Carry bill - allows concealed carry without a permit in most places. Permits will continue to be available.

    I've sent emails to both. However, since Delegate Cole is my delegate, I suspect he is already supporting his bill. Senator Stuart, I believe is a good man and will support the Senate bill also.

    SB245 Question

    Apologies,

    Could someone help by shedding light as to the effect of SB245. I am struggling with both this and HB20 and why we (VCDL and OPENCARRY.org) are so strongly supporting them. What I see is this law, § 44-146.15, is on the books and accomplishes what the summary entails for both HB20 and SB245.

    What I see:
    Literally, in SB245, in section 3 of items this chapter will not be construed to enable:
    The verbage being added is precluding specific prohibition of "carrying, transportation" which I had suspected was previously present in the term "possesion." Also, adding "firefighting" instead of "fire fighting."

    HB20 goes a step further to strike "rights of the people to keep and bear arms as guaranteed by Article I, Section 13 of the Constitution of Virginia or the Second Amendment of the Constitution of the United States, including the..." (otherwise lawful possesion). I believed this to be a rather important component of this bill so as not to allow expedient shifts in law.

    SB245 doesn't really do it for me. I see a "happy" to "glad" situation. Please feel free to disabuse me of any misconceptions.

    How many came to the Committee hearing?

    I don't count. I was there on other business and had to move my car before they got to the good stuff, although I did stop by the patron's office. His legislative adviser was socked that we were there and especially that I was going to video it.

    Don't know - can't hear 'em.

    Still using my Royal manual keyboard and it works fine thank you. See no reason to change my data storage system either as key punch cards do not lose information when Va. Power "temporarily" has a service interuption. Do like these new fangled phones you can carry (OC) on your belt though.
