    Open carry on the radio

    I got a call a couple of days ago, from a producer from KXNT he wanted to do a show on open carry/ police shootings, he was a little unclear, but I got Tim onboard, called him back and we are set up for thursday morning. This should be fun and educational all at the same time. I think it is 870 on am, or you can www.kxnt.com

    KXNT Radio (100.5FM/840AM) I believe this is the correct information for the radio station.

    I heard about 15 min. of you guys on the Heidi Harris show (KDWN) as I was driving to work. Heidi is mostly a pro-cop apologist, but she is also a gun owner.

    From what I heard, she played Devil's Advocate addressing why you guys are out there to provoke cops and get attention by open-carrying. I heard Tim relate his experience on the Strip, being held at gunpoint and having a bunch of his rights violated. Heidi pretty much came from the cop-point-of-view: Why do you have to exercise your rights in a way that makes others uncomfortable?

    The idea of open-carrying, besides the prohibitive cost for many in getting CCWs or coming from out-of-state with a CCW Nevada won't honor, is not to cause people and cops discomfort, fear, or any other negative emotion; it is to defend ourselves, families, friends, and others in need (maybe even cops) and to get to a point where we are left alone and not confronted by cops when we aren't doing anything unlawful.

    Heidi asked if a cop seeing someone walking along a public sidewalk open-carrying ought not to be stopped by the cops and questioned just in case the OCer might actually be a bad guy, who is on his way to shoot up a casino. First, I doubt that some bad guy intent on doing harm is going to OC; or if he is, when asked what he is doing OCing is going to tell the cop :"I'm on my way to shoot up a casino."

    The general premise I think we OCers would mostly agree to re cops contacting us for "investigation" is this: If I am in public OCing, not engaging in unlawful activity, leave me alone.

    Heidi also brought up a scenario where she saw a man holding a woman by the arm and apparently about to become more aggressive with her; Heidi called the cops because she was concerned for the woman's safety. She asked about an actual scenario where a "Chinese woman" had called in a MWAG on David when he was OCing because she was concerned for public safety and questioned whether it was not reasonable in both situations to have the cops involved in the interest of safety.

    I would answer, "No, Heidi. It would not be reasonable to call the police in both situations. Your witnessing a man holding a woman by the arm (battery?), speaking to her in an animated, aggressive manner (assault?) which when taking the totality of the circumstances into mind could lead a reasonable person viewing the same situation to believe a crime was being committed or about to be committed and that the police should be called to check on the woman's welfare, gave rise to probable cause.

    In David's case, he was not engaging in any unlawful conduct, not engaging anyone else in an offensive or aggressive manner, not threatening anyone with his gun. David was merely in public engaged in lawful activity, OCing, and going peaceably about his business.
    There were no existing facts to give rise to probable cause for David to be stopped and questioned by police. While the "Chinese woman" may have had a personal discomfort seeing David OCing, personal discomfort at witnessing lawful activity doesn't give rise to probable cause to believe a crime is being committed or about to be committed by someone who is merely walking on a public sidewalk. It would not be reasonable, nor rise to the level of probable cause, for police to engage David at all."

    I saw that too. Heidi is a suckup for those in power. If she ever asked an official on her show a real question I'd die of shock. She is a backside kisser.

    I listened to the whole show and called in also, I was the one who owned a business. You did a great job! You represented our rights with professionalism and respect. I do like the Heidi Harris Show and listen to it almost every day. She is a good Conservative and has it right most of the time. I think in this instance she was playing devils advocate and going into a place where she shouldn't have gone and you could tell her audience let her know they didn't like it. Over all it was a great piece of publicity to get the message out that we have rights that need to be protected regardless of what the police think is reasonable. two thumbs up guys!

    She always has Gillespie on. I have never heard her ask him one hard question. It's all a free PR/spin gig for him.

    I still want to know what happened to the cop, trying to set up Mr. Darling for a felony DUI to protect Manor's rep and Metro from liability, who lied to the criminal investigators who were working-up the James Manor accident, stating Manor had his lights and siren going when it was proved to be a lie. You or I would go to jail for making a false statement to a cop during a criminal investigation. The lying cop who tried to shield Metro and Manor and set up Darling kinda just faded away into the background.

    So much for accountability!

    I haven't seen anyone here who "likes to antagonize cops". In fact, most people I have seen here just want to be left alone and not have anything to do with cops regarding OC.

    If cops don't want to be antagonized by seeing someone peacefully exercise a right, a non-crime, then they just need to stop reacting to seeing it. I think some cops get off on the opportunity to harass OCers, or at least stir things up.

    I read a recent incident related by an OCer in WV, where OCing is lawful. He was OCing at a store with his young son. He had just finished paying for his merchandise and was walking away from checkout on his way out the door.

    An off-duty deputy wearing plain clothes behind him in line stopped him from leaving, ran his CCW and ID, had him unholster and unload his mag, and gave him attitude.

    The way the event should have gone is: OCer peacefully goes about his business, lawfully OCing, selects and pays for merchandise, walks out of store with his son, and drives home to his wife to enjoy the evening. Cop pays for his merchandise, walks out of the store, and drives home to enjoy his off-duty time.

    The way it went instead was that a busy-body cop, observing no unlawful or disorderly conduct by the OCer, stuck his nose in where it didn't belong to try to stir up **** and take peaceful, lawful OCer to jail.

    That didn't happen because of any "provocative" conduct, let alone unlawful conduct, on the OCer's part.

    I talked to the Producer, he said it was double the work to stitch together because we went over another half hour, he said soory for it taking so long but said we will get it. Once that happens, I will post it on OCDO or if it is to big, Guerrilla Lawfare, and put the link on here.
