I was sitting down waiting for my order at Five Guys when a Charlotte police officer walks in goes to the counter and after a few minutes walks over to me and tells me he is going to disarm me, and that I was under investigation for being a suspicious person with a gun and due to an incident that took place two days ago was his justification of why he was disarming me. The police officer implied that someone called them from five guys. The manager at five guys told me that none of his employees had called the police, and that he was use to seeing me OC'ing there all the time. The police officer told me that I could file a complaint with I.A. or whomever. Since I was not driving I asked him if he was aware that NC is not a stop and ID state, and I got no answer. So he ran my gun's serial number and drivers licence. So the question is was I profiled, because someone was shot two days earlier?

A previous incident having taken place could qualify as RS. However, I would follow up with FOIA requests for records of the incident at the least, and then go from there. I'd also consider talking to an attorney.

lawyer up, file a FOIA, and next time this happens, remember that in NC you DO NOT have to produce an ID if you are not operating a vehicle--you only have to verbally identify yourself, and give your address...

My guess is you weren't stopped and harassed because you were profiled. You were stopped and harassed because you were OCing.

Which is REALLY stupid, because I can't think of a SINGLE instance in the last 3 or 4 decades where some thug who shot someone in public was OCing--those news stories ALWAYS begin with "then he pulled a gun out of his pocket/from under his coat/etc...

We really need to start hitting these police departments hard with formal complaints, Federal 1983 suits, and other administrative punishments. They won't get the message that OC is legal, safe, and socially acceptable until a few of them lose their jobs, or are made to pay big settlements...

Did the LEO cite you? Did he return your firearm? Did you stay and have a burger?

No citation, got my firearm back and it was a to go order and yes the burger was great!!!!! But still not happy with the incident!!

Yes and I also voice recorded part of the incident with my phone, I couldn't record the whole thing because @ first he didn't want me touching my phone!

It does seem like these stories are popping up everywhere. Not just questions being asked by others, but by police, and sometimes leading to violation of rights. This is one reason why a lot of people do not carry openly. They don't want to deal with the hassle of weird looks, police, and store managers.

I don't think we'll ever have any problems here in ENC, but other areas of the state might not be so kind to OC. Also, I've never heard a story of someone with a CHP getting harassed by a LEO in NC. But the point of OC in NC is that it doesn't require a CHP. Every LEO that comes through my line at work, I ask them about OC and they all say that they wouldn't even ask questions and that they have better things to do, etc.

But lately I've been thinking that I really should get my CHP even though I've never had any problems with OC. Most of my handguns are large frame and wouldn't be too comfortable IWB during the summer.

I have a strategy for dealing with it nowadays. I've learned my lesson the first time around and it isn't as scary the second time I can tell you

Or the legislature steps in to qualify what can or can't be done. Which is actually a pretty dangerous thing for OC in my opinion. Whether that tipping point comes as a memo from the AG, a big lawsuit, or just a constant presence is yet to be seen.

To the OP, I would do the FOIA request. And file a complaint with the Dept. YOu might be hard pressed to get a lawyers attention on this one. Your only damage is the time that it took to check you out. Unless you can convince the lawyer that running the numbers was a significant enough violation to warrant their time. It's worth some phone calls though. I'm not saying you shouldn't give it a shot. Just be prepared for a lot of them to be uninterested.

Someone was shot and car jacked 2 days earlier!!

Some 1 flagged him down in front of five Guys!


My guess is that "Granny Smith" was also there and decided she'd teach a young punk a thing or two. Sorry that you were a victim of ignorance of the law.

Got a call from a Sgt today, he said that the leo was well within his rights to secure the weapon for his own safety, he said the officer had know idea who I was or what type of person I was. I told him that I had no idea who the officer was or what type of person he was, and that now that LEO had secured his safety,I was left with no way to secure mine! He said that he was a LEO, so I responded by letting him know that was a law abiding citizen that wasn't doing anything wrong!!!

Sounds like a department that needs to be educated.

Disarming for officer safety only occurs in the case of a detainment or arrest, I believe. This is assuming that a traffic stop counts as detainment, which I would think it does.

This is true the Sgt. I spoke kept saying that when u have a CCW permit, you are required by law to hand over your drivers lic & permit upon request. So I asked him who was carrying a concealed weapon and he had no answer. I spoke to a friend who is also a char/meck leo and he told me that he knows the leo from last night, he is fresh out of the academy they graduated together, get this my friend asked me if I had my gun permit and if the gun was registered, I told him may god help us all and his reply was why? I responded with it's just going to be nuts out in the streets with a bunch of uneducated leo's!

It would be great if a pro-gun organization would rent some bill-board space in various counties to inform the public (and law enforcement) regarding the carry laws.
I can see it now - a plain looking person wearing a holstered handgun and the words "Relax, this is legal in North Carolina" printed alongside.
