I just heard Devvy Kidd last week on Jeff Rense's show mention that we need to get on our state legislators before November about restoring our constitutional state militias if we want to have the full force of exercising our un-alienable RIGHT to bear arms instead of wasting money on the NRA. I think this is a great idea. Any thoughts to expound on this?July 11 at 3:06pm we should follow along the lines of the Alaska state militia in making cops accountable (following proper due process) when contacting citizens to do the right thing. NRS 203.080 Armed association.

1. It shall be unlawful for any body of individuals other than municipal police, university or public school cadets or companies, militia of the State or troops of the United States, to associate themselves together as a military company with arms without the consent of the Governor; but members of social and benevolent associations are not prohibited from wearing swords.

2. Every person who shall associate with others in violation of this section shall be guilty of a misdemeanor.

NRS 412.026 Composition of militia.

1. The militia of the State is composed of the Nevada National Guard and, when called into active service by the Governor, the Nevada National Guard Reserve and any volunteer organizations licensed by the Governor.

2. The Nevada National Guard is an organized body of enlisted personnel between the ages of 17 and 64 years and commissioned officers between the ages of 18 and 64 years, divided into the Nevada Army National Guard and the Nevada Air National Guard.

3. The Nevada National Guard Reserve is an unorganized body comprising all able-bodied residents of the State between the ages of 17 and 64 years who:

(a) Are not serving in any force of the Nevada National Guard;

(b) Are or have declared their intention to become citizens of the United States; and

(c) Are not exempted from military duty under the laws of this state or the United States.

4. If a volunteer organization is formed and becomes licensed by the Governor, it shall consist of an organized body of able-bodied residents of the State between the ages of 17 and 64 years who are not serving in any force of the Nevada National Guard and who are or who have declared their intention to become citizens of the United States.

(Added to NRS by 1967, 1292; A 1975, 798; 1999, 6)

This is the 2nd amendment to the constitution:

A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.

The comma says it all. The government will need an army, therefore the people need to be armed. The people, being the source of all government power need to be able to defend itself against a government that tries to unconstitutionally take the power from the people. Each branch of government has a check and balance against the other, and the people are the check and balance against the government as a whole.

I've always had some heartburn with the above law, which by the way comes from the Nevada Constitution:

ARTICLE. 12. - Militia.
Section. 1.  Legislature to provide for militia.  The Legislature shall provide by law for organizing and disciplining the Militia of this State, for the effectual encouragement of Volunteer Corps and the safe keeping of the public Arms.

Sec: 2.  Power of governor to call out militia.  The Governor shall have power to call out the Militia to execute the laws of the State or to suppress insurrection or repel invasion.

Last year, I wrote the following to Governor Sandoval:

In accordance with Article 12, Section 1 of the Nevada Constitution, what effectual encouragement of the Volunteer Corps (Nevada Militia) has the Legislature provided?

How many licenses have been issued (pursuant to NRS 412.026) to bodies of persons to organize, drill and bear arms as military companies or organizations?

but received no reply; my phone inquiry referred me to the Nevada Adjutant General. No further info received yet, so thanks to your post above to remind me, today I wrote to my senator, assemblyman, Adjutant General, and Dir of the Legis Counsel Bureau, with copy to Gov Sandoval, the following:

Pursuant to Article 12, Section 1 of the Nevada Constitution, what effectual encouragement of the Volunteer Corps (Nevada Militia) has the Legislature provided?

Pursuant to NRS 412.026, how many licenses have been issued to bodies of persons to organize, drill and bear arms as military companies or organizations? How many licenses are current and what are the names and contact information of the companies/organizations?
