my holster is inside my waistband, but as long as my shirt is tucked in the grip is showing. ive heard both that that is open carrying and that it isnt. 1/3 of the gun is showing so i dont think its concealed but i just want to be sure! thanks in advance.

A. If any person carries about his person, hidden from common observation, (i) any pistol, revolver.............., he shall be guilty of a Class 1 misdemeanor.

Most importantly please note: This statute does NOT say partially covered/hidden - no difference if partially covered by trousers or OWB holster. If readily discernible as a handgun it is openly carried.
