This Could Have Been the Appleton Rebellion

We have a couple of posts on the Appleton open carry issue. Now I am not sure if the protests against the police stop were successful. But if this town was in Texas there would have been an overwhelming response.
One thing in this article raised my eyebrow. I thought city/town/village ordinances are not supposed to be more restrictive than the state's. But it seems from that not all states have it that way. If they did, there would be so much confusion. For example one would have to bypass a city/town/village if they had more restrictive laws than the state, or you would have to store your firearm away in your trunk after unloading it every time you entered a city/town/village. Anyway the article is encouraging because the 2A seems to have been whittled down to a 'matchstick'. It is amazing to read that the city police would defy a state law.

What exactly would you be rebelling against in Appleton? There is no local ordinance in question.

The fact that leos stopped law abiding ocers. I suppose my point was that I should have been a part of and should have rounded up some law abiding folks and shown up along with others to protest the handling of the situation by leos. In Austin they too were manhandled the same way as the Appleton guys despite the state law. As a result 300-400 people showed up to protest the issue. In our case it was not a local ordinance but the fact that our OC doctrine based off the 2A, was snubbed. I don't know weather a counter rally was as large or as successful to let local leos know that we won't be intimidated. To summarize: What got the Texans fired up so much more than us?

The largest event I have seen in WI was the Green Bay Open Carry Picnic which was around 100 people in attendance from all over the State. Trying to get WI gun advocates together for any reason has been difficult. The Appleton incident was resolved immediately. The police figured out that OC of a long gun is not prohibited on the spot and admitted so. The question of whether 4A rights were violated will be up to the courts to decide if a suit is brought. The opinion of many LEO is that no rights were violated.
U.S. Circuit Judge Diane Sykes ruled on an arguably similar case regarding Jesus Gonzales in 2012.

To tell you the truth, I haven't applied myself to MAKING time to attend get togethers much less rallies. I work in the twin cities which is an hour and five away each way. Then it is the distance to Madison or Milwaukee and its burbs, Racine, etc... Must be that the Texans are much more patriotic than me. Now that AB-9/165 are on the floor, we may need a large organized, well mannered rally to show force to get the lawmakers to get the bills fixed or rescinded. I know you and other OC veterans meet at Lizzy's, IHOP, etc... I just might get my leo buddy to come with me to a gathering now that he sold me that Winchester for pennies on the pound, or maybe my wife to come to get the feel of things.

Never really known any LEO's to openly admit this about anyone that has their rights abused so this is no surprise at all.

And this is the problem, isn't it? If *you* can't be bothered to show up, why should anyone else?

Anyone can show up to an event or rally on a sunny, warm Saturday mid-morning. But when it becomes remotely inconvenient for all too many people, well, the passion for the movement takes a backseat, doesn't it?

Don't let the excuses get in the way of your standing up for what you believe. MAKE the time and effort to get involved.

Agreed. But it may be easier in Texas. They don't have winter. They are a republic, thus Texans are more patriotic because they can secede anytime. Remember the Soviets wouldn't dare invade us via Texas?
However I believe Wisconsinites in general are very apathetic towards the cause, whatever it may be unless it is a socialist one. I see them walking around in my town with gloomy faces with the words 'No Hope' or 'I depend On Government' written on their foreheads. Why couldn't we come up with the slogan 'Don't Mess With Wisconsin'?

One thing you are right about I need to direct some of my energies towards the OC/2A cause not just for other Constitutional causes only.

Come on, you know. 'the man!'. :D
Safe and conservative appleton is so oppressive. They be holdin us people down! I can't even walk around a school ON PUBLIC SIDEWALKS with my HK 91!!! We are oppressed by the power, the man, the suits!!!!

On a related note, I was working at this one house in central wisconsin that just jettisoned their chicago trash renters, so the good people were worried about that urban trash coming back with their urban attitudes. As his wife was working inside, old guy showed me his protection--an unloaded pistol in a case in his locked vehicle.
"lotta sandra fluking good that'll do you if they come back" I said.
Well, I don't have my concealed carry he replied.
Don't need one. We have open carry here. He had no idea and when I elaborated more. He definitely had a need (and his wife did also), but I had to work him into accepting it's OK and legal to carry a pistol on your hip in public. He didn't have any idea about OC and was a hard sell, but was a vet and a gun owner and had a need, yet he still didn't know. So I guess I should have just walked to his wife with an AK to educate him.......

Public Sidewalks are typically part of the Public Right-Of-Way and not School Grounds are they not?
Man, I ain't gonna touch that one. Heck, I get mad that I had to take care of the grass on the street side of the sidewalk, but as I understand it, it's not even my property.....
Heck, some places make you fix your sidewalks, or face a fine. But if it's not your sidewalk, why do you have to pay for it? Too many nuances in places that have sidewalks.
I like places w/o sidewalks...and come to think of it, curbs also. ;)

Think of it as an easement. You "own" it and must maintain it, but it is not your "private" property...

I got tired of all the 'sharing' government does of my property and money is private property too. They share my paycheck, they share whatever I purchase, they share in whatever revenue whoever sells it to me gets, etc. I'd like it more if government shared less of my private property. ;)

Almost all of your events occur in eastern WI, if you want to pay for my gas i will happily attend ALL of them, until then you will just have to take into consideration that it may be more then some people can afford. I am sure others are in the same situation. I also only know of these events from occasionally stopping by this forum, perhaps if you worked on some advertising that got out to more then your regulars, more would attend. I have never seen nor heard of any events advertised other then here.
Central WI.
I mean no offence but i like to be blunt and to the point. I would actually have attended had i stopped into the forum to check local events but as it is a rare event i did not and as stated above these events dont get much publication.

Ya there are more meet and greets advertised on the wi pro 2a and wi carry FB pages than on the forum anymore.

easement: an interest in land owned by another that entitles its holder to a specific limited use or enjoyment.
Your property ends at the boundaries indicated on your parcel plat map. The "state" grants itself a easement.

The state grants access to your property via a easement, the sidewalk, where a citizen cannot be trespassed. State agents, letter carriers, utility workers, check the water meter dude, can enter upon your property without your consent in the norm pursuit of their official duties.

If a state agent goes beyond his official capacity (violation of law) while on your property, even on a sidewalk, they can be trespassed. A citizen cannot "camp out" on the side walk that transits your property. If the citizen is within the plat map boundary he is on your property, you just cannot do anything about it unless the citizen gets "all up in your grill."
