Hey guys,

So I often walk the dog and go fishing at Lake Crabtree Park in Cary off Aviation Blvd. I had a jogger stop by me the other day and tell me that guns are not permitted at the park. I told him I didn't see any signs. He just shrugged and kept running. I forgot to check for signs on the way out.

Does anyone know if this park prohibits firearms?

but are they allowed to ban weapons in the whole park or have they designated it an athletic facility or something in that stupid exclusion list. They may say it's against the rules, but would it hold up to a court challenge?

Complete state preemption of firearms laws except localities may regulate the possession of firearms:
  • In public-owned buildings
  • On the grounds or parking areas of those buildings
  • In public parks or recreation areas

If the park is owned by Cary it is against their ordinance to carry, I am not sure if it has to be posted. Residents should not have to be mind readers.

Umstead is OK if you have a CC permit and adhere to the other guidance (not in offices or areas managed by USACOE.

Guns and Fireworks

Firearms and other weapons are prohibited except that those with a proper permit may possess a concealed handgun in permitted areas and under the requirements of North Carolina G.S. 14-415.11. All firearms and weapons are prohibited in state park visitor centers and park offices. (EXCEPTION: Federal law (36 C.F.R. 327.13) prohibits loaded firearms or ammunition on those lands and waters at Falls Lake, Jordan Lake and Kerr Lake state recreation areas managed by the state parks system and owned by the U.S. Army Corps of Engineers.)

The Corps of Engineers is a real pain - they need to step up and smell the roses. They're making criminals out of otherwise honest citizens while BGs are already ignoring the law.
