but there was so much wrong with this "procedure" today that I don't/wouldn't know where to begin. I will say that testimony I heard today was truly incredible, as in not to be believed, unable to be believed, sometimes so comical as to elicit laughs and snickers from the court room observers. I thought I was listening to "Sheldon Cooper" from "Big Bang Theory" testify. Not wanting to screw up the rest of the day or any further "proceedings", I'm not saying anything for awhile except that I could have sworn the "Railroad" station was a few blocks down on Staples Mill Road, not at Parham and Springfield. I guess it just depends on if you want to take a ride or be taken for a ride.

I'm whipped but was asked on another site as soon as I got home.

Here's what I posted:

Yep...it was worse than I thought possible. I had warned him that he may be found guilty in GD but this was absurd.

First, the Bus driver's testimony didn't match the complaint, then a long line of reasons he was afraid including changing the story 5 times. The last, he said he was afraid beause he had glared at him. When asked how he could tell if he was glaring from behind through the back glass when the driver had on sunglasses, he said I focused on him and he gave off bad feeling".

The Judge was a substitute judge and when Scouser testified, the judge was busy talking to the clerk and filling out paperwork on other cases. When the video was introduced the Judge wouldn't watch it. He said the man saw a gun, that's all that's important...after listening to 15 minutes of bunk about how he was cut off and the driver was speeding past him.

It was downright silly.

Then he gave him a year which is WAY out of the sentencing guidelines for someone with no criminal record.

So, round 2 is in September with a jury and full time judge. There was a court reporter BTW so the story changes, etc are now a matter of record.

It was pretty obvious after 5 minutes that this was decided. One thing that really stood out was that the names of the students was subpoenaed and the school said they didn't know.

The Henrico Officer had said that all the students had seen it and were afraid.
When the driver was questioned, he admitted the kids hadn't seen anything and had no reason
to be afraid.

When he was asked why he didn't call the police he stuttered and stammered but
never answered.

His biggest complaint that he repeated several times was that when a School Bus needs to
turn everyone should yield.

You don't need grounds to appeal to Circuit Marshaul. GD is a court not of record so an appeal is granted just to get it to a court of record.

Yes, the appeal was noted and an appeal bond posted although there was a screw up there too. The Judge was really out of his pay grade.

this whole mess is really asinine. half-a-dozen different stories. no threat. pitiful! 25 bux on the way! wish it could be more...

btw, my wife and i were at the meet-up at bellisimos a couple of months ago. i am still trying to get two more venues up this way for OC lunches.

The judge was obviously prejudiced against the defendant (very anti-gun) and in way over his head from the start. His actions during the “trial” while Scouser was testifying should make anyone wary of being in his kangaroo court. (Unless you are driving without a license and don't speak English)

I know Dan will have much more success with a real judge and jury. It just saddens me that Scouser and his family have to continue dealing with the lies the judge allowed to be spewed by the C/A and the bus driver.

People that were not even involved in the case were shocked and upset by the verdict. A lawyer sitting next to me was so shocked that a deputy had to quite him down. The judge did not listen to Scouser's testimony and read during it or just seemed bored by it. The judge was not interested in anyone unless they plead guilty or had a prearranged plea deal setup.

There were people in the courtroom that were shocked at the court's disregard/disinterest in the defense presentation of facts. If I didn't know better, I'd say the case was tried and punishment set before court was ever called to order this morning. We have a travesty of justice that will NOT go unanswered.

My personal observation: Henrico doesn't like LAC with guns, makes it as difficult for them as possible and will make them spend time & money to defend their good name. There is apparently no innocent until proven guilty - if you are charged then you must be guilty and they will find a way.........even if not supported by the facts.

Yes there is going to be an appeal and I fully expect the outcome to be very, very different.

Flabbergasted beyond words at this point.

All I can think to say is thank goodness for all the supporters who were able to fund a court recorder, so that this outrage can be corrected.

I take great comfort that all this evidence will be preserved for the subsequent civil litigation.

I'm still not able to do this calmly, so

just the highlights:

Guilty. 12 months with 6 months suspended on condition of good behavior for 3 years.

Supposedly the original bond and bond conditions (the ones that were in effect this morning as scouser entered the courthouse) were to be imposed. That was a personal recognizance bond for $1,000, plus the bond to cover the costs of the appeal trial. Additional conditions not even imposed before trial were "added" just for grins and giggles (I'm guessing on the reason they were added).

Nope! Judge managed to screw that up beyound all recognition, if you know what I mean. The courthouse ATM has hit multiple times to get enough cash to meet his release bond. Folks at the Magistrate's office and in the Sheriff's office were bound and determined to take their lunch break, so what should have been a 15-minute process of handing over the bond cash and getting him released turned into a multi-hour interlude. Return contacts with the court will be necessary to straighten out the

Notice of appeal was filed before he got released. Now not only does NSA have records of all his cell phone calls but it's highly likely his phone was forensically examined/copied while he was being processed. (Hote/hint - do not ask for your phone from whoever is holding it if you are going to be processed/booked. Take a paper list of important phone numbers because you will not be allowed to use your cell phone anyway. They can get away with it and they will do it just because everybody loves to go fishing.)

We may have been able to find a temporary job for scouser. Seems a conviction for brandishing makes getting a CDL-driver job a bit difficult. It it comes through it will not be as glamerous or pay as much as driving the big rigs but it should keep him and the family from being kicked out into the street.

Now the real work begins. It should never have gotten this far, but the fact is this is where scouser is at the moment. About the only good thing I can think of at the moment is he is at home with wife and son instead of deciding if he wants his hacksaw in a chocolate or yellow cake.

On a personal note - I am pissed. At least the reaming I went through down in Surry was because they wanted to screw me over for having committed contempt of cop. What happened today was "if you are here in court you must be guilty" as demonstrated by a judge who did not bother to pay attention, except when he ruled "that has nothing to do with it" even though the Commonwealth Attorney had not voiced an objection. Well, that and the fact that the big taxpayers in the county need to be protected.

Rest for now if I can, then back to the grindstone tomorrow. It's merely a delay, not a defeat. That and it opens up all sorts of possibilities to really rip a few new ones.

Thank you to all who helped get us to the courthouse today. Unfortunately, scouser is going to need help again getting back to the courthouse for a real trial where he will have an honest chance to present his case and be found not guilty. When your grandchildren ask "What did you do when scouser got railroaded, granddad?", you will be able to say "I stood up beside him to get justice."

I wanted to post this separately -

Every person that stopped to talk with scouser's supporters after we got outside the courtroom (not going to say "after the trial" because IMHO he did not get one) used the same word in describing the complainant school bus driver -

Pretentious.

That's a pretty big word, and I was frankly amazed that some of those folks used words that big. But when you get not consensus but a unanimous vote on his character, you can pretty much be sure the nail was hit squarely on the head.

Too soon for such potential considerations.

First the appeal where Scouser will get an impartial hearing by a jury of his peers. Then perhaps some compensation for the damage to his reputation and other actual losses. Punative award? - Would hope so.

Scouser has a loving family, a child that clearly adores him. They all need each other right now and we will be there to help in any way that we can.

Surry learned that when you falsely accuse one of us, you gain the attention of many. Henrico must not have gotten that memo - These people just don't quit, they won't take the easy way out and abandon one of there own.

There is right and there is wrong and this entire thing stinks of "Not from around here? Well you are in trouble then ain'tcha? We are gonna make an example out of you, ya hear."
