Subdivision (10) of subsection 1 of this section does not apply if the firearm is otherwise lawfully possessed by a person while traversing school premises for the purposes of transporting a student to or from school, or possessed by an adult for the purposes of facilitation of a school-sanctioned firearm-related event or club event.

RSMo 571.030.4. Subdivisions (1), (8), and (10) of subsection 1 of this section shall not apply to any person who has a valid concealed carry endorsement issued pursuant to sections 571.101 to 571.121 or a valid permit or endorsement to carry concealed firearms issued by another state or political subdivision of another state.

There is no requirement to conceal in the statute(s).

Out and about

Went and had a tire fixed at Walmart after lunch and milled around a bit. Picked up a couple things needed for supper, and I don't think anyone even noticed. Either that or I didn't care if they did, not sure which?

But there is a "concealed carry permit by the state the school is located in" federal law and if as the poster stated he does NOT have a ccw from MO, then he violated the GFSZ act, not a wise choice if you like hanging on to your dollars and freedom.

True. It seems that three officers do not know federal law, or think that it would not be applied for a citizen standing on a sidewalk. I think that those three officers reacted as I hope we all wish that all officers would react. As to the time it took to respond, it seems that that LEA is not so reactionary, another kudo to that LEA is in order I think.

Carried around Fulton today with no problems, one or two odd looks in Walmart but that was it.

In short, one must have a permit issued by that state to legally carry within 1000' of a K-12 school.

The federal Gun Free School Zone act. Having a firearm within 1,000 feet of a school is against federal law. The exact wording can be found with google, bing or your search engine of choice.

You are EXEMPT from the law if you have a concealed weapons permit from the state the school is located in, IE you would need a Missouri permit for a school in Columbia MO, another state's permit would NOT exempt you from it.

Read a lot, OC as you somewhat found out is not real popular here in MO and without a doubt a lot of cops lack knowledge on the topic. Several of us have been educating for several years but it ain't done yet.

It is RARE that the GFSZ act is used by itself, it is typically an adder charge, but it HAS happened and if you do not have a CCW from MO it is NOT wise to violate a federal firearms law, you will NOT retain your gun rights if you are convicted.

On your private property, even across the street from a GFSZ, you are exempted.

A property owner may discharge a firearm on his property where the discharge of a firearm is not prohibited.

Thanks for the info. Honestly had no idea about that law, I do have a question though. Does that apply even when school is out because my town has four schools spread out, small town and regardless of where I walk I will mostly likely be within range of a school. If someone can PM me or something to help me understand this better I would appreciate it.

The GFSZ Act is a bad joke played upon the American people. It deters no serious criminal and potentially makes a criminal out of otherwise honest people.

I know of no instance where this federal law has ever been prosecuted as a primary offense.

Penalty
18 U.S.C. § 924(a)(4) establishes the penalty for violating GFSZA:
Whoever violates the Act shall be fined not more than $5,000, imprisoned for not more than 5 years, or both. Notwithstanding any other provision of law, the term of imprisonment imposed under this paragraph shall not run concurrently with any other term of imprisonment imposed under any other provision of law.
Note: A conviction under the GFSZA will cause an individual to become a "prohibited person" under the Gun Control Act of 1968. This will bar them from legally owning firearms for the rest of their life.

Carried to Columbia for my kid's dentist appointment, no signs posted on the door so I went in and no one batted an eye. After that we headed out to walmart and as I was walking through the second set of doors I was stopped by a man who pointed at my holstered pistol and asked. "You can do that?" At first I was thinking he was against it, but before I could even say a word he continued with. "I'm not against it, I was just wondering if I could do it too." So I moved out of the way of the doors and explained what I knew about the OC laws in the areas that I travel, told him to make sure to check the laws in the cities before he carried, and he informed me that he was a CC and had not known that you could OC in Missouri. I gave him the forum address and we both went about our day.

Last stop of the day was Cracker Barrel for some food, had one person look at me odd but did not say a word, think I might have shocked one of the waiters because they bumped into me and looked down and saw the pistol, but no issues or problems.

Did go for a small walk with the family afterwards in town, just to enjoy the cool night. According to my wife a cop had driven past and did a double take so fast she was surprised his neck did not snap. Lol.

Rare solo OC experience

I rarely OC by myself, hard to believe but true. If i don't have LMTD or DOC with me (he can tell you what a little nervous nelly I can be) I just get abit shy some times....

Oh, i probably (more than likely) nknow more about OC then almost anyone in the State of Missouri but...

OK, today on I-94 in O'Fallon (LMTD land) I pulled up for gas at a QT with an O'Fallon P.D. car in the lot. Like everyone does I got out filled the tank and went in to buy my lottery ticket for Wed.
The Officer was walking out as I walked in, I opened the door for him, my 3:00 Sig in plain view and he said "thank you", I said "your welcome".

Life goes on. Carry open, carry often, don't get excited...........

I still tend to alternate pretty frequently. Depends on where my day is taking me. If I kinda feel that vibe that somewhere there may be trouble, it's easy to put on an over shirt or a jacket, especially now that the weather is changing.

Just a normal walk, as I was walking I had someone shout at me and when I looked they gave me a thumbs up and said "open carry yeah" Things like that make ya smile.
