I think some folks are mixing up DUI with DWI.

Some states use one term, some the other, to mean driving with a BAC above the statutory limit. Some use OUI.

In Texas, there is both a DWI offense and DUI offense, and neither of them is in the Traffic Code. DWI is in the Penal Code, and it's operating a vehicle while above 0.08 BAC, or while shown to be intoxicated by any substance, shown by other means (officer testimony, etc.) DUI is in the Alcoholic Beverage Code, and it's for a minor (under 21) operating with any detectable BAC.

You can try to define them however you wish, but the only definitions that matter are those in each state's statutes.
