I've had to contemplate this one for a while. So I did a little digging.And if done in uniform could be abuse of authority under color of law.
The person who filed the complaint said he had a record of some of the interaction with Dominguez on video, but did not want to prosecute.
Leibowitz said Dominguez was not wearing his police uniform, was not driving a police car and he did not identify that he was an officer, but he told the man to stop selling drugs to his son.

That top cop carries no remorse, no regrets, for threatening, with death by violent acts, his fellow citizen. He only cares about the image of the department.

No excuses. I suspect that no criminal charges were filed because he is the AC and the shop employee knows this. I am very confident that a ordinary dad would not have been extended the same "courtesy", or received the same treatment by LE. It would have taken a jury to get a ordinary dad out of a terror charge.
I maintain my position that Asst. Chief Dominguez should be permanently terminated from any LE employment opportunity. He is/was reactionary and incapable of maintaining his professional conduct. I shudder to think what he is capable of doing if his son succumbs to his addiction.
