Just a quick note for the Madison 5. WCI board met via email today and we will retain legal counsel if needed to fight the DC charges. This is a fundamental issue and Madison is clearly operating far outside of the law.

Its unconscionable that the Wisconsin AG can confirm that open-carry is legal, that our state and federal constitutions guarantee's us the right to carry, yet our ability to exercise this right without being arrested hinges on whether ONE PERSON is fearful even though there is no disturbance.

As the majority of WCI's legal involvement involves civil litigation, we are currently discussing with our attorneys who will be filing what appears to be the inevitable civil lawsuit who would be the ideal resource legally for fighting the DC charges as well.

I have Paul, McX, Springfield1911, and Shawn's contact info. I still need the 5th person's contact info.

You know what "provoke(s) a distburance" to me? The police overstepping their bounds, ignoring the law, and citing people for breaking the law when they clearly weren't. Someone issue the Madison PD a disorderly conduct citation for me!

I also find it very kind that the Madison PD cites the 3 men who gave their ID, even when they didn't have to. That's a nice parting gift.

I am really disappointed by this. I was really optimistic that Madison would try to do the right thing. It looks like they're just trying to dig their heals in, and I think this is an all-out attack on open carry. They are probably hoping to set some precedent that open carry is disorderly conduct...

Just when you think things are deescalating, someone declares war :(

A DC charge because a person "felt uneasy" around individuals exercising constitutional rights? Sue her for being part of a conspiracy to deprive the Five of their civil rights.

Title 18 U.S.C. § 241. Conspiracy against rights of citizens
If two or more persons conspire to injure, oppress, threaten, or intimidate any citizen in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; ... They shall be fined ... or imprisoned ... or both;

I emailed an Open Letter to the Wisconsin State journal with the basics of my email to the mayor and sent the story on to the Drudge Report.

Nice - I suggest everyone take a minute to send an Open Letter to express outrage. We need to make some NOISE.

I believe the id's of the other 3 were also illegally obtained by means of intimidation. The threat to arrest was obvious intimidation.

Their ID's were LEGALLY obtained. It is perfectly within the law for cops to lie, threaten and coerice. How do you think they get people to consent to searches?

Good idea - I suggest that someone on this forum that is disconnected from WICarry.org and possibly a donating member to WPR send them a note. I am neither but someone has to be.

Some courts would beg to disagree. It's been determined (and I'm sure someone here can cite the caselaw for me because I don't have it handy) that the mere prescence of that many police officers is intimidating enough, especially after others were arrested, to make it non-consensual. IMHO, it was illegally obtained.

There is nothing illegal with OC as long as you don't go to the five places you cannot carry. The police are doing illegal activities, not law abiding citizen who happen to open carry. Cities cannot enact laws more restrictive than state law (preemption).

I love it when people think there needs to be a law to make something legal. That is the opposite of how things work.

We hear this all the time in CT. "We need an open carry statute." Nope. Our state law says you may carry a firearm when you obtain a permit. That is all. Therefore for us, CC and OC is legal with a permit.

I hate broken logic.

Letters to the Madison mayor are ok, but be aware that he hasn't much control over the Chief of Police, who is appointed by the Police and Fire Commission and serves at their pleasure. Secondly, the mayor is anti-gun so if you say you aren't coming to town to spend your money, he'll probably say "good!"
