The mugger can be tried and convicted because he does not have the authority. No one from the government will be tried and convicted for enforcing the law as it is on the books. They have the authority.

Ability to try and convict does not translate into legal authority to do so.

In Hitlers Germany it was quite legal to commit mass murder. And the ability to do so existed.

Though Hitler hardly had authority to do so.
