I've never heard of a notice to appear in 7 calender days but maybe they are making an exception for him. So this is in criminal court and not traffic court for the VC section only?

I didn't ask that; I should have. I assume it's criminal court since the other codes were on the notice.

I'm wondering if they made an exception because he is an out of state visitor. Although I would have expected them to delay as long as possible just to make his life hell.

Well that was easy.

Of course the arrest was still illegal, but that's a big claim to show in court. It would have to be made on Constitutional grounds and challenge the validity of (e) directly.

All property returned except his gun. Needs to file forms to get it released.

That was the impression I got last night.

Of course, CA LEOs are, by law, not permitted to release a firearm without a LEGR, as I understand it.

On behalf of the Calguns Foundation, I did reach out to and speak at length with the subject person this morning. I respectfully request that no additional details be published until we and counsel have an opportunity to review all of the facts; depending on the path forward, it may take some time before more information can/should be released. Understanding that this is of great interest to our gun advocate community, please also consider that more discussion at this time is counterproductive to the process.
