Jackson County DA REFUSES to enforce state laws, says they are unconstituional

Wow. What a bold and principled stand.

Some practical concerns:

Some of the laws he is refusing to accept referrals on would likely pass muster with the SCOTUS.

What recourse would those who want the laws enforced have? Could they use another prosecutor to indict and try?

I hope this DA is successful in his efforts, however a few shoes seem to be dangling.

One other question: What city is in Jackson County? Or, is the county purely rural? Most of us are woefully unfamiliar with Wisconsin geography.

There are no large cities but Black River Falls is the County seat. I think population is around 10,000 or so. Jackson County is about 100 miles North of Madison and about 60 miles South of Eau Claire.

I think that his primary reasoning might be that since they declared it a fundamental right (and the Wisconsin Supreme Court has kinda tossed our own RKBA around as a less than fundamental right) it's now up to the state to prove that they have a compelling interest in exercising their police power. According to the Wisconsin Supreme Court that burden; as far as RKBA stands, has been on the citizens to prove they had a more compelling interest to exercise their rights.

Kinda a shifting of the burden of proof sort of thing.

Secondly he may be reading into the self defense language used in Mcdonald and anticipating that the higher courts would rule that your right to such doesn't end at your front door.

Thanks, I suspect that the SCOTUS would be more than willing to have State SCs set a stricter standard for laws whose infringement on the right is arguable. If the DA is correct on the net effect of the WI SC and SCOTUS future rulings, he's OK. If not, I think his posterior is on the line. They guy has guts.

Nik Clark, Chairman and President of WCI has hinted that WCI is preparing for another lawsuit. It may be against city and county park bans or 167.31.

IF WCI files a lawsuit against 941.23 by the end of JULY, I will throw $1,000 into it's war chest. I challenge Spartacus to do the same.

The press release for Jackson County DA is awesome. Locals knew that this DA will not pros. under 941.23. Let us find as many DA's and Sheriffs and Police Chiefs that share a similar position. Collect all these into a database for WCI.

I was told by a WCI BOD member that they do not want to appear to be SUE HAPPY. Well, WCI is a no-profit, right. I know exactly what that means. I did the books for a 501(c)(3) with a 600k+ annual cash flow for 18 months. A non-profit can raise all the money it wants to, but the catch is that it must spend it. It's all about cash flow. It WCI raises losts of money, and its members want lawsuits, then that is what WE should have.

If the DA is correct on the net effect of the WI SC and SCOTUS future rulings, he's OK. If not, I think his posterior is on the line. They guy has guts.

Guts indeed. He could certainly face the threat of some sort of discipline from the Supreme Court if somebody filed a complaint with the Office of Lawyer Regulation. While we celebrate, we should acknowledge this man's courage.

I just read about a former municipal judge who was reprimanded for refusing to hear cases about parking tickets. (Of course the objection was that it was costing the city thousands in unpaid citations. They weren't objecting that justice was not being done, they objected to the impact on city income.)

Well, we have OC and the WI SC has said that our concealed carry laws need work. The legislature has passed 2 different CC laws and the idiot governor has vetoed both. He is not running for re-election this year so we have a more than decent chance of getting some kind of CC.

We, however, are pushing for an AZ, VT, AK carry provision where a permit would only be issued for reciprocity.

If we can get a Wisconsin DA coup d'état going, maybe it will never get there and the legislature will change the friggen laws like the the WSC TOLD them to years ago. Most of our counties are rural and most probably have conservative DA's so if we got a majority of them to go along with Mr. Brass Balls Esq. it may be the way to go.

A little background info: The WSC pretty much told the legislature in their opinion in State v. Hamdan that they need to fix the swiss cheese CCW statute. I also believe we have a conservative majority on the court for the time being.

Thank you sir, but just so you know, I expect many of my learned colleagues across the state to quarrel with my analysis, or wait for the legislature to take affirmative action, in lieu of declaring certain laws unenforceable, and I would never presume to speak for another elected DA. I did send AG Van Hollen a copy of my release, but I have not heard from him, and that's OK; he has a much differnt job than I do, and probably a great deal more on his plate that this issue. With that said, I appreciate your kind words.

If we all contact our local DA's and bring their attention to this maybe we could get some of them out of the closet too! Why don't we make an organized effort to do so? Get everyone to email every DA one by one. Bring their attention to this and ask them to jump on the bandwagon!

My guess on why he didn't include the GFSZ is that SCOTUS specifically mentioned "Schools" as a place where firearms could be regulated. SCOTUS did not say "School Zones" however; (at least that I found) so maybe the DA missed that?

It seems to me he is basing his entire view on the fact that it is now considered a fundamental right and ignoring that SCOTUS didn't answer all the "reasonable restriction" questions. I think this may be the right way to look at it. Being a fundamental right definitely causes the states police power to be secondary to the right; at least IMHO.
