A private citizen cannot buy a firearm with the intention to make a profit.
That's not for me to explain. I'm sure a Commonwealth Attorney or prosecutor would happily oblige you in the case of any confusion in court.

How bout the ATF’S paragraph right above the one you quoted from the cite:
As a general rule, you will need a license if you repetitively buy and sell firearms with the principal motive of making a profit. In contrast, if you only make occasional sales of firearms from your personal collection, you do not need to be licensed.

Draw your own conclusions. I have drawn mine, and others seem to agree. ATF guidelines and Federal statute use somewhat vague language, in my opinion purposely so, in regards to what it means to be "in the business of" selling firearms, or selling "for profit." Anecdotal as some instances may be, personally, I err on the side of caution. As always, YMMV and IANAL.

"Courts have identified several factors relevant to determining on which side of that line your activities may fall, including: whether you represent yourself as a dealer in firearms; whether you are repetitively buying and selling firearms; the circumstances under which you are selling firearms; and whether you are looking to make a profit. Note that while quantity and frequency of sales are relevant indicators, courts have upheld convictions for dealing without a license when as few as two firearms were sold, or when only one or two transactions took place, when other factors were also present."

No worries.

Profit seems to be considered in several examples and not considered in several other examples. Making a profit is not the point unless you are "in the business" of selling firearms regardless of frequency of sales. Thanks The Truth for the informative cite.

I didn't get "really defensive," I'm not sure what you're even talking about or why you feel the need to interject a personal argument when we are discussing statute and guidelines, but thanks for your input. It's duly noted.

I was asked how someone that is not me would prove intent, and I cannot speak to how someone else would prove intent on a made up situation that is entirely subjective and specific to said hypothetical situation. Unless you have a specific case you would like me to provide opinionated commentary for, I have no answer for HOW intent is proven. The point is intent must be proven.

I was asked to provide a cite to back up my position. I did so. Not sure what else there is left to say about it.

When their anti-guns agenda fail, they will start to disenfranchise individual gun owners into CONVICTED FELONS........and they will make up whatever charges they see fit to obtain the convictions.

Checking my pulse...nope nor have you been anointed mod.

Why you are grumpy at me over over your posting ATF faux pas posting(s) is quite beyond my understanding especially since you, as a long tenured member, are aware of the necessity of presenting correct information, especially regarding this type of material ~ buying/selling/transfer of firearms between unlicensed citizens as well as from/between FFLs.

Forty days ago in another thread you mentioned members who have passed, who, as you stated, “ ...a way of telling people to STFU and GFY that was as concise as it was pointed.” but sorry, this member believes everyone is entitled to express themselves w/o vulgarity!

If you insist on posting misinformation, w/o viable cites, which could cause a reader of your nonsense posts issues, anticipate other members to unceremoniously step in correct you!

As previously posted, I have no earthly where or how or why you have a burr in your skivvies against me...but sir...the problem is strictly yours, and yours alone!
