New to opencarry.org, but not new open carry. This is great, printed a couple to pass out. I live in NLV, spend a lot of time alone at warehouse near Rancho & Cheyenne (which is Las Vegas). T12 Spinal Cord Injury in 2008 from a motorcycle accident left me partially paralyzed from waist down. Have open carried since 2009. LEO's have praised me for my doing it. Seems the ones in public that have said something to me think I have special privileges because I am in a wheelchair or they think I am ex-military (I am not). At first I would just smile and nod, but I have learned that if I take a couple extra minutes and "educate" them on THEIR rights and the Nevada Laws (that just because I am in a wheelchair DOES NOT make me any different that they are, I just get a better parking spot than they do) most, if not everyone I have spoken to about this starts to beam with pride, as if I have helped them remember how proud they should be to be an American. I open carry a SW9F in a yaqui holster.

Sheriff pulled a friend and i over.

Hello everyone! im new to opencarry.org or at least i've been around just lurking and reading but today i decided to register and post.

i moved here about a year ago and have been open carrying here in Reno Nevada since i arrived, never had much trouble had alot of people come up to me and ask about it.

so today i decided to register and post because on the way home from moving stuff out of storage we got pulled over by a sheriff on a motorcycle he gave us a ticket for my derpy friend not having his registration on him, everything went fine we immediately told him we were both armed and open carrying he didn't even draw or look to worried just told us to put our hands on the dash ... then 3 seconds later told us to get out and switch the licence plates around because he had the registration sticker on the front plates not the back so we did that while he was issuing the ticket.

after he gave us the ticket and asked us why were open carrying and then proceeded to laugh when we told em it was our right and its for our own protection ect ect... he mocked us and said we should just relax and enjoy life sometimes... whatever that means?

i then replied '' well we cant exactly carry you around with us 24 hours a day and 7 days a week sir''

we banters back n fourth a bit and then when we were about to leave he then said '' If i really wanted to be a ass i could site you for open carrying in Reno because of the Reno city ordinance overrides the state law about open carrying in the state of Nevada'' he then went on to tell us we should look it up and probably not open carry anymore and kept saying '' he was pretty sure it overrides the state ordinance''

when he said that it came of VERRY threatening and i wanted to start an argument right then and there but probably wouldn't of been the best idea...

i got his name and badge id..... if i can do anything with it .....

so i started googling.... and ive researched the laws here ALOT... evry time i hear something i always look it up ... but for a sheriff to bring some BS city of reno code that overrides the constitution and state law made me research some more... and thats how i found this thread and ive since printed up 10 of your excellent pathlets! thanks!

im 99% certain that he is incorrect... and please correct me if im wrong... but how do police cops sheriffs what ever not know the law? this is mind boggling....

ALSO what should i do with a officer who DOESN'T know the law and tries to do something about me legally carrying ?


and to finish things off i would like to state that i put in for my CCW almost 4 months ago.... and still waiting for it T.T when will it come! i want to avoid derpy cops.... but at the same time... if i wanna open carry and not have to wear bulky clothing i wanna know im in the right ( well speaking strictly law, i know im always in the right to keep and bear arms)...

Welcome to the forum. If he legally could have cited you for OC he would have. He was just trying to intimidate you. The only thing cities and counties can regulate is discharge of firearms not anything else. (except for Las Vegas which requires registration) If you have a question about the law look it up yourself, don't listen to cops because they will tell you their opinion.

i was always under the assumption that i was supposed to inform them i had a firearm when they pull you over... tho i could be mistaken and just be recalling HOW to let an officer know you are armed..... XD tho if he asked me to step out of my car i would inform him first right? i don't like being drawn on and held at gunpoint.... tho i was FULLY expecting him to unholster and hold us at gunpoint when we told him.

I thought you did have to tell them you were armed. When I got pulled over by Sparks PD and I didn't tell the officer, when his partner saw my gun from the passenger side, he backed up and pulled his gun on me and yelled at me for not informing him I was armed.

Never believe what a cop tells you. He is under no obligation to tell you the truth, or for that matter to know the law. If he pulled his firearm on you for nothing more than being armed, he was in the wrong and corrective action should be taken.

I don't care how long ago this happened. You need to write a respectful letter to the sheriff/chief and describe the situation. Ask him if it was proper for the officer to pull his gun on you. Don't bother asking him if you should have informed. Give as many details as you can. He can probably find a record that will identify the two officers on the scene.

In Nevada there is no law requiring one to inform, but if you are carrying concealed with a permit and an officer demands to see your permit you must show him your permit. The confusion may arise from that.

There is also nothing in the Reno Municipal Code banning open carry of a firearm.

You have no obligation to tell them, but there is a judgment call on your part. I don't volunteer that info right away, but if I am going to get pulled out, or they are going to spot my gun, I will tell them first, so there is no surprise. That lowers the "freak out" tendency on their part. Not that I have to, just that it is prudent, so I don't get Erik Scott'd. I make sure my hands are visible when I state clearly "Just so there are no surprises, I am 413 on my right hip.". Ever since I have started handling it this way, I find I get dealt with much more civilly and respectfully. I think ht by using their own terminology, it incites a more "peer" response than a storm-trooper-vs-peasant one. They use the number codes for a reason. It removes a lot of the miscommunication that can occur. You can use it to your benefit as well

Very nice, but I know of no paper shown to the cops that do anything but get them pissed off .... anyone have a cop say "you are under arrest" & you toss out a paper and they say "oh, sorry, you are free to go."

Because the DPS and the NVSCA have changed the CCW recognition list, the pamphlet has been changed to reflect this. Rhode Island permits are no longer valid, but Idaho Enhanced permits and North Dakota Class 1 Permits are now recognized.

Jury Nullification

I just read the updated pamphlet and a few of the links in it and it got me to thinking that I should tell you guys about Jury Nullification for those unaware. You can google it, but basically it means, "Jury nullification occurs when a jury returns a verdict of "Not Guilty" despite its belief that the defendant is guilty of the violation charged. The jury in effect nullifies a law that it believes is either immoral or wrongly applied to the defendant whose fate they are charged with deciding."

This should be in EVERYONE'S mind because often juries make and / or change laws on the spot by their decisions. So if you are called into jury duty and you do not agree with the laws or how the laws are being used, you have NOT ONLY the power to vote your conscience, but an obligation to do so. Keep that in mind and add it to your arsenal against tyranny.

Since OC is a big part of fighting Blind Obedience and that any of us oc'ers may find ourselves in court in one way or another, I figured this to be enough on-topic.

It most definitely IS legal to carry a handgun with a barrel of less than 12 inches in plain view and loaded as long as the gun is registered with one of the sheriffs departments somewhere in Nevada! One only needs a permit if he carries concealed. Just don't carry on public parks or schools, childcare facilities, or any place that has a metal detector such as a courthouse or an airport. And always carry your blue card with gun which shows the gun is registered!

Only Clark County has a registration scheme. Only Clark County residents are required to use it. Other sheriffs will laugh at you.

Public parks are legal by state law, though SOME jurisdictions have their own illegal ordinances with varying levels of harassment. Henderson, for example, has no problem with it.

Schools and child care facilities are legal with the permission of the owner/president.

Public buildings at airports are legal for open carry, except for beyond the metal detectors (you may have meant this.)

Carrying of the blue card has never been required, and they have finally mostly stopped lying about it. Sometimes they will tell you now to "keep it in a safe place." Regardless, you actually have no duty whatsoever to retain it. I hold ceremonial burnings for mine.
